Technically, if copyrighted content is being shared using torrent tracker without copyrights owner's consent - it is illegal. Even though the content is not being directly downloaded from torrent - torrent tracker is still being used as the mean of sharing.
The copyright law lets you make your own copy of the game/movie. But it does not grant you the right to download another copy of it from somewhere else.
Unless the game states something different in the ToS or Agreement.
Think of it like this, you bought 1 copy of the game. You did not buy multiple copies of it.

You are allowed to make a back up copy of any movie, the law does not cover where that back up copy needs to be obtained from, therefore downloading a copy of a movie you already own is legal (albeit a loophole)
