Marijuana is still federally illegal so if the president or whoever calls it unconstitutional or whatever you will still get arrested by federal not local officers.

It's still technically illegal for the time being. It's against federal law and any case where the feds are involved will be prosecuted as normal. Local law enforcement will not be required to prosecute, but will be able to if the feds ask them or if they basically want to snitch to the feds. It's a really wierd situation right now. If you are a Colorado or Washington state resident, you should not take this time out to:
  • Smoke pot in public
  • Start your own forest of pot plants
  • Wave it in front of law enforcement
Basically, continue on as you were until Colorado and Washington eventually sue for their rights to govern how they see fit. Cops are gonna crack down based on the cop and the case.

obviously one shouldn't spark a blunt in a heavily populated area with children around and what not.

State and local police do no possess federal jurisdiction or federal police powers, so therefore are not able to arrest for it. The only people that would logically be pursued are mass growers and distributors, just like the medicinal suppliers. I agree however, that you should probably still keep it on the down low for the time being.

This is true. However if they want to arrest for some bullshit reason, then turn you into the feds, they can legally do that. The feds can also "commandeer" officers through their own power.

You're right though, they're not looking for someone getting high with their friends in a basement. They're looking for farmers and large dealers.

I guess I could chime in from the law enforcement side. I am a state officer and my ex husband is a Fed Ice Agent. I actually don't have a big problem with Cannabis. I would rather deal with someone a bit stoned than completely drunk anyday. That being said, medical marijuana is legal here with a card. I will assume it will work the close to the same way in Washington that it does here. Don't walk around in public, Don't smoke it around children, you have to be 21 years old and so forth. One example of where you cannot smoke legally would be a reservation. Even those with med cards. So keep in mind that if you travel through a rez and get pulled over by rez police with cannabis then you can be cited or arrested depending on what you have... Border Patrol agents, Customs agents, FBI and ICE Agents have authority pretty much anywhere within the U.S. and can override State Authority if needed. As for Feds "comendeering" state/county officers; It usually has to be an emergency and completely justifiable, then they will still only have peace officer powers and only in an assisting manner. Too much liability workingout of your jurisdicition should something go wrong. Like stated before, the random person won't have much to worry about, it's the big manufactuers/distributers.
 
I live in Washington, and well it was confusing. Pro-legalization people were against the prop 502, and anti-legalization were for it. I suppose people were against it due to the awfully low legal amount you can buy/have in your system, and people were for it since it would bring in a LOT of tax money.
I've heard that it might take up to a year to get implemented, and places might still not allow it, say downtown Seattle might allow it but not Bellevue, or the other way around.
I find it sad for medical MJ users, since their limit went from 15 grams to 1 gram, which is basically nothing. In my mind, the government was basically like "oh so you want marijuana to be legalized? Well here you go, have 1 fucking gram, have fun with that shit"
