In a way, it's kind of the kickstarter dude's fault for making people wait a ridiculous amount of time for such a wanted product, but on the other hand it shouldn't be legal to just make a low-quality knockoff as fast as possible just to get a big share of the profits

best thing to do is claim you have a patent when it's actually pending. most imitators won't bother if they believe a lawsuit could happen.
on the other hand, one could probably get a lot of money from the imitators by claiming it's only pending when it's in fact fully patented, as I don't think a lawsuit would be thrown out on the grounds that a kickstarter page was out-of-date on any patent info.
