Look it's as simple as this. Whether or not you saw the warning, a warning was given. All you have to do is change your spray and wait a day. (rhyming not intended.) people found it offensive. I also have a question why gay porn as a spray? I know it's a bit personal, but I never understood that.

It's not a rule but it ought to be, which is something I would put in my revision and "Harming your team for an extended period of time." People were offended enough to confront him about it.
"ought to be" and "is a" are quite a different things. I've learned it when I was talking to Zebra about "your mom" offenses. It either falls under the rules' offenses - or it's not an offense. As simple as that.
Argument for the ban: Being disruptive equates to griefing. Greifing is against the rules. There is no specific rules against say, flaming a sniper's scope, but that is griefing. There's no specific rule against setting up a tele in a spat that would drop you off the map if you step forward, but that too is griefing.
Spraying something that has the whole trade server in a tizzy and refusing to move it after being requested to cease and desist? I would call that greifing.
I would argue that the sexuality of the spray in question (lol, does that not sound retarded?) has nothing to do with anything. The argument that probex is trying to make is a bad one. We don't need more rules.

I'm not here to debate whats right and whats wrong with you, here all i'm gonna say. He was banned by an Admin the ban was for 1DAY and was justified BY AN ADMIN We've had the whole sprays discussion before and never once have we come to a conclusion it's the gray area of all rules, but even bottiger has said that we have the right to confront people about offensive sprays, he was warn he didn't see it so he says, and he was punished I say again FOR A DAY.

This is a serious misrepresentation of the actual reaction. The majority of noise and reaction was from Patriot. Also, griefing tends to be intentional - i like my spray, i dont have it or use it to shock.
Admins aside obviously - this has all sorts of problematic reasoning about doing whatever a prejudiced minority of players ask the resonable majority to do.
You need to honestly ask yourself the basis for peoples objection.

I would argue that anything that distracts traders from trading is greifing the trade server.
Then I would suggest you argue that the people who were freaking out over your spray were instead the griefers. If they flooded chat, or voice with reactions to your spray then you weren't' being the disruptive one. They were.
Dude. You can disrupt the trade server and cause it to empty. Don't act like you can't grief it.
:: shrug :: not my call. I would think that if the fuss being raised was annoying enough, or if he was just dumb about it it would be. Wasn't there. Not even my call to make. I would still say it's plausible.

except he wasn't refusing to remove it, he just wasn't paying attention and didn't see faron's warning. now that he has heeded the warning i wouldn't be against keeping the ban in place considering he's now aware that despite the sexuality of the spray (which really isn't the reason for his ban, it's just a detail which some people just find unappealing to look at), and would probably pay better attention to what's going on in case someone is talking to him regarding his spray or something.
i would personally just remove the ban out of principle, he didn't do anything that was explicitly against the rules; he just missed a warning about a rule that was purposely kept vague because offensiveness is a very broad spectrum, i know for a fact a lot of people would find a dick and a vagina to be equal in terms of 'shock value'.
then again, there's no rule about offending people, i don't see how 'offensive sprays' could be a bannable offense, all the whilst offending people in graphic detail over the mic or in chat is a-okay, the only rule that pertains to sprays is "Sprays that are illegal as per the laws in the country where the server is located." homosexuality is illegal in some countries, but not in the civilized world (where i'm guessing the server is located). disruptive is also very cryptic, so much stuff can be argued as disruptive.
